Making a Spanish Will

If you have any assets in Spain it is very important to make a Spanish Will.

Taking time to do this will make things so much easier for your loved ones when the time comes. In fact, without one, inheritance matters can go on for years and get very costly and complicated.

When nominating the beneficiaries of your Will, do bear in mind how the Spanish Inheritance tax system works.. We can discuss this in full detail with you and also more details can be found in the Spanish Inheritance page.

It is usually composed in dual column, in Spanish and also the native language of the applicant. It is then signed in a Notary and this is where the official version remains until it is required. You will be given a copy for your records.

Changing a Spanish Will

Due to the way the Will system works in Spain, if circumstances change and the Will is no longer worded the way you want, you will have to make another Will as before and this is then lodged as the latest Will .

Using a Spanish Will

When a person passes away, it is necessary to contact the Ministry of Justice in Madrid to obtain a certificate of last wishes. This certificate lists any Wills that have been lodged by a Notary and it is the last one that is used and acted on.  (More on this matter is dealt with in the Spanish Inheritance page)
